Email marketing and CASL: what businesses in London, Ontario need to know

Canada's Anti-Spam Legislation (CASL) applies to commercial email sent to or from Canada. It's stricter than the US rules many email platforms are built around, so it's worth getting right from the start. Every program we set up follows it.

In plain English, CASL asks for three things.

1. Consent. You need permission before you send a commercial email. Express consent is when someone actively opts in, for example by ticking an unticked box on your sign-up form. Implied consent can come from an existing business relationship, such as a recent purchase or enquiry, but it expires after a set period. We record how and when each person joined your list so you can show it if you're ever asked.

2. Identification. Every email has to say who it's from and include a way to contact you, such as your business mailing address.

3. A working unsubscribe. Every email needs a simple way to opt out, and opt-outs have to be honoured quickly. We set this up so unsubscribes sync automatically across your forms and platform.

Bought or scraped lists don't meet CASL, so we don't use them. We grow your list the slow, reliable way: sign-up forms, in-store sign-ups with consent, and lead magnets your customers actually want.

How we keep your emails out of spam

Good content doesn't matter if your emails land in the junk folder. Gmail and Yahoo now require bulk senders to authenticate their email and make unsubscribing easy. This is what we check and set up:

  • SPF: tells inbox providers which services are allowed to send email for your domain.
  • DKIM: adds a digital signature so providers can confirm the email really came from you and wasn't changed.
  • DMARC: tells providers what to do with email that fails those checks, and sends you reports about it.
  • One-click unsubscribe in the email header, as Gmail and Yahoo expect from bulk senders.
  • List hygiene: removing bounced addresses and long-inactive contacts so your sending reputation stays healthy.
  • Warm-up for new domains: increasing sending volume gradually instead of mailing your whole list on day one.
  • Spam complaint monitoring: watching complaint rates and fixing the cause if they creep up.
